Ratio Decidendi

The court found that the Respondent failed to prove desertion as there was no evidence the show cause letter was served on the Claimant and the Claimant had been granted permission to be absent. The Respondent did not demonstrate attempts to reach out to the Claimant as required by law. Consequently, the termination was unlawful and unfair. The Claimant was entitled to compensation for unfair termination, notice pay, and gratuity as per his contracts. Claims for breach of contract for the remainder of the term and for leave pay for 2012 were dismissed as unproven or statute barred. NSSF dues were not payable to the Claimant but to the statutory body.
