The court found that the applicant had complied with the conditional stay order by depositing the decretal sum in court. The respondent, fully aware of the court's order and the deposit, should have sought release of the funds from the court rather than instructing auctioneers to attach the applicant's property. The attachment and proclamation were therefore irregular, unlawful, and an abuse of the court process. The respondent's advocates, having acted contrary to clear court orders, were held personally liable for the auctioneer's charges.
