Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the respondent is entitled to a stay of execution of the judgment pending appeal.
  2. 2 Whether the respondent demonstrated substantial loss would result unless stay is granted.
  3. 3 Whether security for due performance should be furnished as a condition for stay.

Ratio Decidendi

The court found that although the respondent did not specifically demonstrate substantial loss, the decree in question was a money decree of a substantial sum, and if execution proceeded, the appeal could be rendered nugatory. The court exercised its discretion to grant a stay of execution, conditional upon the respondent depositing the entire judgment sum into court within 14 days. The court also ordered the respondent to pay the auctioneer's charges within the same period. The application for stay was therefore allowed on these terms, with costs awarded to the claimant.

Court Disposition

Application for stay of execution allowed with conditions.

Orders

  • Stay of execution of the court's decree pending hearing and determination of Civil Appeal No E058 of 2023, conditional on the respondent depositing the entire judgment sum of KES 5,582,606 into court within 14 days.
  • Respondent to furnish the claimant with a copy of the deposit slip or receipt.
