The 2nd respondent failed to determine the applicant's licence renewal application and did not provide reasons or an opportunity for the applicant to be heard, contrary to the requirements of fair administrative action under Article 47 of the Constitution and the Fair Administrative Action Act. Section 21(5) of the Kiambu County Alcoholic Drinks Control Act provides that a licence remains in force pending determination of a renewal application.
