The High Court held that the Kwale Chief Magistrate’s Civil Case No. 146 of 2020 was filed in a court lacking pecuniary jurisdiction, as the amount claimed exceeded the statutory limit for a Senior Principal Magistrate. As a result, all proceedings and orders made in that court, including interim orders, were null and void ab initio. The High Court further held that it could not transfer an incompetent suit filed without jurisdiction to another court under Section 18 of the Civil Procedure Act, as there was no valid suit to transfer.
