Ratio Decidendi

The Tribunal found that it was functus officio, having already issued final orders in the dispute between the parties, and therefore lacked jurisdiction to entertain the tenant's application for stay of execution. Furthermore, the Tribunal determined that a similar application was already pending before the High Court, rendering the present application sub judice and an abuse of court process. The Tribunal also noted that the tenant's application was misconceived, as there were no orders of 5th January 2024 on record, and the file had only been reconstructed on 11th March 2024. Consequently, the Tribunal dismissed the tenant's application and awarded costs to the landlord.
