The Supreme Court held that while compliance with procedural rules is essential, the delay in filing the 8th respondent's replying affidavit was not inordinate and sufficient reasons for the delay were provided. In the interest of justice, the court declined to strike out the affidavit. The applications for additional evidence and joinder that the applicant sought to strike out had already been dismissed by the court in previous rulings. Therefore, the instant application to strike out pleadings was dismissed. The court emphasized the need to balance procedural compliance with substantive justice, especially where no prejudice was demonstrated and the delay was adequately explained.
