Ratio Decidendi

The court held that the mandatory death sentence imposed under Section 296(2) of the Penal Code is unconstitutional, following the Supreme Court decision in Francis Karioko Muruatetu & Another v Republic. The court found that the Petitioner.s rights were infringed by the failure to consider his mitigation. Having reviewed the Probation Report and noting the Petitioner.s reformation and the 16 years already served, the court set aside the death sentence and substituted it with a custodial sentence of nineteen years from the date of arrest.
