Stay Application / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the Court of Appeal should grant a stay of proceedings in Nairobi High Court Petition No. 505 of 2019 pending appeal.
  2. 2 Whether a negative order dismissing a preliminary objection is capable of being stayed.

Ratio Decidendi

The Court of Appeal held that the High Court's ruling merely dismissed the applicant's preliminary objection and did not order any party to do or refrain from doing anything. Such a negative order is incapable of execution and, as established in precedent, cannot be stayed. The applicant failed to demonstrate that there was an order capable of being stayed or that the appeal would be rendered nugatory without a stay. Consequently, the application for stay of proceedings was dismissed as there was nothing to stay.
