Ratio Decidendi

The court found that the appeal had already stood dismissed by operation of a previous order due to the appellant's failure to file the record of appeal within the stipulated time. Since there was no pending appeal on record, the court held that it had no jurisdiction to extend time for filing a record of appeal. The application was therefore misconceived and unmerited, as it was not preceded by a prayer for reinstatement of the appeal. The court emphasized that it would be a pretense at justice to purport to extend time in the absence of a subsisting appeal, and that the proper course would have been to seek reinstatement first. Accordingly, the application was dismissed with costs.
