The court found that although the law recognizes that registration of land in one party's name does not defeat a claim of trust, the plaintiff bears the burden of proving the existence of such a trust. The plaintiff failed to provide sufficient evidence that the defendant was registered as proprietor in trust for the deceased or herself. The evidence showed that the deceased was only a cousin to the defendant and had been allowed to live on the land by the defendant's brother, whose licence was later revoked.
