The appellate court found that the trial magistrate erred in holding the appellant wholly liable for the accident in the absence of clear and independent evidence. Given the conflicting accounts and lack of corroboration, the court held that liability should be apportioned equally between the appellant and respondent at 50:50. On quantum, the court determined that the award of Ksh.900,000 as general damages was excessive compared to similar cases and substituted it with Ksh.500,000. The total award, including special damages of Ksh.9,610, was then subjected to the 50% liability apportionment, resulting in a net award of Ksh.245,805 to the respondent.
