Ratio Decidendi

The court found that the applicants failed to establish a prima facie case with a probability of success, as the authenticity of their ownership documents was credibly challenged by the respondents and remained unaddressed by the applicants. The court held that, in accordance with the principles set out in Giella v Cassman Brown, the failure to satisfy the first condition for the grant of an interlocutory injunction was fatal to the application. Consequently, there was no need to consider the remaining conditions of irreparable injury and balance of convenience. The application for a temporary injunction was therefore dismissed with costs to the respondents.
