Ratio Decidendi

The court found that the claimant had not established the full claim for weekly rest days, leave, public holidays, and underpayments due to lack of evidence at the hearing. However, since both parties had endorsed the computation by the district labour officer, and the respondent's counsel submitted that the respondent would pay the amount calculated by the labour officer, the court held that the claimant was entitled to the sum of Kshs.85,551.90 as computed. The court therefore entered judgment for the claimant for that amount, with interest from the date of filing if not paid by the stipulated date, and awarded costs to the claimant.
