Ratio Decidendi

There was no constructive unfair termination. The parties mutually agreed to separate on 08.06.2020 and subsequently failed to agree on separation terms. The claimant's resignation letter of 22.06.2021 was misconceived as the contract had already lapsed. No compensation for unfair termination is justified. The only award to the claimant is for 31 days of accrued leave. The respondents are entitled to return of company property or its value. Each party bears its own costs.

Court Disposition

Claim partly allowed; counterclaim partly allowed; no finding of constructive dismissal; parties to bear own costs.
