The Court of Appeal held that the National Land Commission (NLC), as a state organ, is immune from execution by garnishee proceedings under Order 29 Rule 2(c) of the Civil Procedure Rules and section 21(4) of the Government Proceedings Act. The only lawful mode of execution against the government is by way of mandamus, and only after strict compliance with the statutory procedure, including obtaining and serving a certificate of order against the government. Five Star Agencies Limited failed to comply with this procedure, rendering its garnishee proceedings incompetent and unsustainable. The Court further found that the Kenya National Highways Authority (KENHA) was not a necessary party...
