The trial court erred in law by revisiting the issue of liability after an interlocutory judgment had been regularly entered against the respondent, which rendered liability final and not open for reconsideration. The only issue left for the trial court was the assessment of damages. Furthermore, the trial court was under a legal obligation to assess damages even if it found against the appellant on liability, to facilitate appellate review and avoid unnecessary remittal. The appellate court, therefore, set aside the dismissal, entered judgment for the appellant, and proceeded to assess damages under the Law Reform Act and Fatal Accidents Act, considering the deceased's age, earnings,...
