The court found that the Claimant could only prove employment with the Respondents from December 1996, based on NSSF records, as the Respondents' business was registered in 2003 and no evidence linked earlier employment to them. The Respondents failed to prove the alleged theft or provide valid reasons for termination, and did not follow due process as required by law. The dismissal was therefore deemed unfair and unlawful. The court awarded the Claimant compensation for one month's salary in lieu of notice, service pay for 20 years, house allowance at 15% of salary, and 12 months' salary as compensation for unlawful termination, totaling Kshs. 826,000, plus costs and interest.
