Ratio Decidendi

The trial court failed to comply with the mandatory requirements of Section 131 of the Criminal Procedure Code by not affording the applicant an opportunity to show cause before ordering forfeiture of her cash bail. This omission constituted a breach of the rules of natural justice and rendered the orders of forfeiture and the requirement for further cash bail irregular. Consequently, the High Court set aside the orders of 18th February 2020 and 3rd March 2020, restored the original bail terms, and ordered a refund of the additional cash bail paid by the applicant.
