The evidence of the plaintiff and the contradictions in the defendants' testimonies established that the sale was by private treaty, not public auction, and that statutory and advertised conditions of sale were not complied with. The 3rd defendant, acting under the 1st defendant's instructions, breached the law, making the 1st defendant vicariously liable.
