The respondents did not oppose the application. The court held that the applicant was not guilty of dilatory conduct and that it would be in the interest of justice to grant the extension of time. The court exercised its discretion in favour of the applicant, finding that the requirements for extension of time under Section 79(G) of the Civil Procedure Act and the guiding principles from relevant case law were satisfied.
