Procedural Posture

Civil Application / Ruling on Application for Extension of Time to File Notice of Appeal

  1. 1 Whether the applicant has provided sufficient reason for the inordinate delay in filing the notice of appeal.
  2. 2 Whether the court should exercise its discretion to extend time for filing the notice of appeal under Rule 4 of the Court of Appeal Rules.

Ratio Decidendi

The court found that the delay of almost four years in filing the notice of appeal was inordinate and the reasons advanced by the applicant were not plausible. The applicant failed to disclose when the court file was traced or how its absence prevented filing the notice of appeal. There is no requirement under the Court of Appeal Rules to lodge the notice of appeal together with certified proceedings. The court, exercising its discretion, held that the explanation for the delay was unsatisfactory and dismissed the application for extension of time.
