In the absence of such evidence, the court accepted the claimant's assertion that he was not paid his terminal dues. The claim for underpayment of salary was dismissed as the claimant's payslips showed he earned more than the statutory minimum wage. The court also found the claimant's assertion of never taking leave or being denied leave for eleven years to be incredible, especially as a unionisable employee.
