The High Court held that the Tribunal erred in entering summary judgment against the appellants without a formal application and without affording them an opportunity to be heard. The Tribunal misconstrued Section 75(1) of the Co-operative Societies Act, which does not oust the requirement for procedural fairness or the right to be heard. The Tribunal is subject to the Civil Procedure Rules and must ensure that parties are given a fair hearing before making adverse decisions.
