Ratio Decidendi

The court found that the first plaintiff, Francis James Ndegwa, did not exhibit any written authority to sign the plaint and verifying affidavit on behalf of the other nine plaintiffs, as required by Order I rule 12 of the Civil Procedure Rules. This defect was fundamental and could not be cured by amendment. The verifying affidavit was also found to be defective and non-compliant with Section 35 of the Advocates Act, and its striking out left the plaint unverified. The court held that these defects were fatal to the suit, and since the plaintiffs had been given ample notice to correct them but failed to do so, the plaint was struck out in its entirety with costs to the defendant.
