The court found that only Title No. Thegenge/Karia/288 and Sweetwater Plot No. 1/41 formed part of the deceased's estate, as there was no evidence that Parcel No. Naromoru/Block 2(Muriru)/920 or other referenced assets belonged to the deceased. Applying section 38 of the Law of Succession Act, the court held that, in the absence of a surviving spouse, the net intestate estate must be equally divided among the surviving children. There was no evidence of gifts inter vivos or advances to any child, nor were any of the beneficiaries minors.
