Procedural Posture

Originating Summons / Ruling on Costs After Withdrawal of Suit

  1. 1 Whether the defendant should be awarded costs following the withdrawal of the suit by the plaintiffs.
  2. 2 What principles govern the award of costs upon withdrawal or discontinuance of a suit.

Ratio Decidendi

The court found that the defendant had actively participated in the proceedings, including setting aside an interlocutory judgment, defending the suit, and cross-examining witnesses. The plaintiffs withdrew the suit after some witnesses had testified, and had previously been ordered to pay costs on specific applications. The court exercised its discretion under Section 27 of the Civil Procedure Act and Order 25 Rule 3 of the Civil Procedure Rules, considering the conduct of the parties and the circumstances of the case. The court concluded that there was no good reason to deny the defendant costs, and therefore awarded costs of the suit to the defendant, to be taxed by the taxing master.

Court Disposition

Suit withdrawn; costs awarded to defendant.

Orders

  • The suit is marked as withdrawn.
  • The defendant is awarded costs of the suit to be taxed by the taxing master.
