Procedural Posture

Garnishee Application / Ruling on Notice of Motion for Garnishee Order Nisi

  1. 1 Whether garnishee orders can be issued against the garnishees who are agents and instrumentalities of county governments.
  2. 2 Whether the Government Proceedings Act applies to county government entities and their agents for purposes of execution of court decrees.
  3. 3 Whether the applicant demonstrated that the garnishees hold monies due to the respondent to justify garnishee proceedings.

Ratio Decidendi

The court found that the garnishees are agents and instrumentalities of county governments, and as such, the Government Proceedings Act applies to them. Execution cannot issue against such entities without compliance with the statutory procedures for executing against the government. Furthermore, the applicant failed to demonstrate that the garnishees held any monies for or on behalf of the respondent that could be subject to garnishee proceedings. The requirements for issuance of a garnishee order were not met, and the application was therefore dismissed. Each party was ordered to bear its own costs.
