Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant was wrongfully and unlawfully dismissed from employment.
  2. 2 Whether the claimant is entitled to three months' salary in lieu of notice for wrongful dismissal.
  3. 3 Whether the respondent had reasonable grounds to summarily dismiss the claimant for gross misconduct.

Ratio Decidendi

The court found that the respondent had reasonable grounds to suspect the claimant of committing the offence of stealing by servant, as the claimant was found in possession of bottles of drinks resembling those stored by the employer, and failed to satisfactorily explain why he brought such items into the restricted premises. The court held that, under section 17(g) of the repealed Employment Act, such suspicion constituted a valid reason for summary dismissal. Consequently, the claimant was not entitled to salary in lieu of notice, but was entitled to the undisputed sum previously deposited in court by the respondent as terminal dues.

Court Disposition

Claim for three months' salary in lieu of notice dismissed; judgment entered for claimant for admitted sum only.
