Ratio Decidendi

The Environment and Land Court has jurisdiction to hear and determine appeals that were pending before the defunct Provincial Land Appeals Tribunal at the time of its abolition. The Applicant's right of appeal had accrued prior to the repeal of the Land Disputes Tribunal Act, and there is no statutory provision extinguishing such accrued rights. Section 30 of the Environment & Land Court Act and the relevant Practice Directions provide for the continuation of pending proceedings. The ELC Act grants the court both original and appellate jurisdiction over land disputes, and the repeal of the Land Disputes Tribunal Act did not extinguish the Applicant's right to have his appeal heard.
