Ratio Decidendi

The court found that the Applicants failed to demonstrate that the Respondent had been served with the documents for execution and a penal notice warning him of the consequences of non-compliance. Therefore, the prayers for arrest and committal to civil jail could not be granted. However, to give effect to the judgment and decree for equal sharing of the subdivided land parcels, the court found it necessary and just to dispense with the Respondent's signature on all relevant documents. The Land Registrar, Kirinyaga County, was directed to give effect to the decree by proceeding without the Respondent's signature. Costs of the application were awarded to the Applicants.
