Procedural Posture

Criminal Case / Ruling on No Case to Answer

  1. 1 Whether the prosecution established a prima facie case to require the accused to be put on his defence for the charge of murder.
  2. 2 Whether the accused acted in self-defence or with malice aforethought when he stabbed the deceased.
  3. 3 Whether the accused was provoked and whether such provocation negates malice aforethought.

Ratio Decidendi

The court found that the evidence established the accused was provoked when he found Jackson molesting his wife in his house. The subsequent fight, in which Jackson and his colleagues, including the deceased, assaulted the accused, placed the accused in a position where he acted in self-defence. The court held that the prosecution failed to prove malice aforethought or that the accused unlawfully killed the deceased with the requisite mens rea. The act of stabbing was found to be a desperate measure taken in self-defence against multiple aggressors. The court concluded that the accused had no case to answer and acquitted him of the charge of murder.
