Ratio Decidendi

The Court found that the Respondents failed to comply with the conditional stay order requiring deposit of security within 60 days from 16/1/2020. The security was provided 16 days late, and no leave for extension was sought. As a result, the conditional stay lapsed on 17/3/2020. There being no subsisting stay of execution, the Applicant is entitled to proceed with execution of the decree. The Court also held that contempt allegations cannot be entertained without a formal application. The application for police security during execution was found meritorious and allowed with costs to the Applicant.
