The court, exercising its discretion under rule 4(1) of the Court of Appeal Rules, found that since the respondents did not oppose the application and the extension sought was for a reasonable period of 21 days, it was just to grant the extension. The applicant was therefore allowed seven days from the date of the order to lodge and serve the Notice of Appeal, and fourteen days thereafter to lodge and serve the Record of Appeal. The costs of the application were ordered to be in the intended appeal.
