Ratio Decidendi

The High Court lacks jurisdiction to strike out a notice of appeal or appeal that is pending before the Court of Appeal. The proper procedure for such an application is governed by Rule 80 of the Court of Appeal Rules, which vests exclusive jurisdiction in the Court of Appeal to strike out a notice of appeal or appeal. The plaintiff's reliance on Order 42 Rule 35 of the Civil Procedure Rules was misplaced, as that provision only applies to appeals filed in the High Court, not those before the Court of Appeal. Consequently, the application to strike out the notice of appeal was incompetent and had to be struck out for want of jurisdiction.
