Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection Regarding Jurisdiction

  1. 1 Whether the High Court has jurisdiction to hear and determine the suit in light of Articles 162(2) and 165(5) of the Constitution of Kenya 2010 and Section 13 of the Environment and Land Court Act.
  2. 2 Whether the dispute is purely a land matter or a civil contract.

Ratio Decidendi

The court found that, although the suit originated as a contractual dispute for the sale of land, the central issue in the amended plaint is the transfer of title to land, which falls squarely within the jurisdiction of the Environment and Land Court as established by Article 162(2)(b) of the Constitution and Section 13 of the Environment and Land Court Act. The High Court is expressly divested of jurisdiction over such matters by Article 165(5) of the Constitution. Therefore, the High Court lacks jurisdiction to hear and determine the suit, and the matter must be transferred to the Environment and Land Division for hearing and disposal.
