The Tribunal found that the remedy of striking out a defence is only available where the defence is clearly a sham or discloses no reasonable triable issue. In this case, the Respondent raised a genuine issue as to whether the Claimant had already been paid the sums claimed, specifically referencing a payment made in 2005. The Tribunal held that this was a valid point worthy of being admitted to trial and that the Respondent was not acting unscrupulously or mischievously. As such, the Claimant had not established a proper basis for striking out the Defence. The application was therefore dismissed with costs in the cause.
