The supplementary affidavit of Samwel Mulei and the affidavit of Titus Ngungi Joseph, both sworn on 27th September 2017, were not formally filed despite leave being sought and granted. Consequently, they were inadmissible and expunged from the record. Additionally, the video clip, being electronic evidence, was inadmissible for lack of the required certificate under section 106B of the Evidence Act.
