Procedural Posture

Civil Case / Ruling on Contempt Application

  1. 1 Whether the contemnors were properly served with the court order alleged to have been disobeyed.
  2. 2 Whether the contemnors had knowledge of the court order and willfully disobeyed it.
  3. 3 Whether the withdrawal of the application against the advocate (alleged nexus) affects the legal basis for contempt.

Ratio Decidendi

Although the court found that valid court orders were issued and disobeyed, the only legal nexus connecting the contemnors to the orders was through their advocate, Naomi Njeri Kariuki, who was served as company secretary and acted for the contemnors. However, the applicant withdrew the application against Kariuki, and she denied acting for the contemnors at the relevant time. Without this nexus, the court found that service and knowledge of the order by the contemnors became disputable and unclear. As a result, the court held that the legal basis for finding contempt was not established and dismissed the application.

Court Disposition

Orders
