The plaintiff, as registered proprietor, is entitled to the statutory protections of the Land Registration Act until his title is nullified. However, the 3rd defendant demonstrated that the grant to the 1st defendant, under which the plaintiff acquired title, was revoked, raising a substantial question as to the validity of the plaintiff's ownership. Given that damages would not be an adequate remedy for either party and both have competing claims, the court found that the balance of convenience required preservation of the suit property.
