The court held that, under section 38 of the Law of Succession Act, the estate should devolve equally among the surviving children. Although the daughters-in-law had not taken out representation for their late husbands, the court invoked Article 159(2)(d) of the Constitution to overlook this technicality, noting that the widows had lived on the property and would suffer injustice if excluded. The protestor had renounced his right to inherit, and the applicant failed to prove that any inter vivos gifts excluded...
