It found that the injuries sustained by the respondent were primarily soft tissue injuries with a mild head injury and transient loss of consciousness, from which the respondent fully recovered. The court held that the trial magistrate's award of Kshs. 400,000 as general damages was excessive in light of comparable awards for similar injuries, and reduced the award to Kshs. 300,000. On special damages, the court found that only Kshs. 5,090 was proved by receipts, not the Kshs. 13,870 awarded by the trial court.
