The Environment and Land Court lacks jurisdiction to entertain challenges to grants issued under the Law of Succession Act, as such matters fall within the exclusive jurisdiction of the High Court or Magistrates’ Court, depending on the value of the estate. The Plaintiff's title, having been issued pursuant to a grant, cannot be challenged in the Environment and Land Court. However, the power to strike out pleadings should be exercised sparingly and only in the clearest of cases. Since the Plaintiff had already testified and the merits of the case had not been fully canvassed, the application to strike out the plaint was not merited.
