Ratio Decidendi

The court found that only nine months had elapsed between the last step taken in the suit (16th December, 2016) and the filing of the application for dismissal (13th September, 2017). As Order 17, Rule 2 of the Civil Procedure Rules requires a lapse of one year without any step taken before a suit can be dismissed for want of prosecution, the application was premature. The court therefore held that the application was incompetent and ordered it struck out, with costs to abide the outcome of the suit.
