However, the court held that the claimant was wrongfully regarded as a casual for seven years, during which NSSF was not remitted, entitling him to service pay under Section 35(5) of the Employment Act. The claimant was also entitled to payment in lieu of untaken leave for the period he was treated as a casual. Claims for notice pay, damages for discrimination, and other reliefs were dismissed for lack of proof.
