Ratio Decidendi

The court found that although the plaintiff had filed a notice of change of advocates, the notice was never served on the defendant's advocates. The defendant's advocates served the hearing notice on the previous advocates, who acknowledged receipt. The court held that it would not be in the interest of justice to visit the mistake of the advocates in failing to serve the notice of change upon the plaintiff. Exercising its discretion, the court set aside the dismissal order and reinstated the suit, subject to the plaintiff paying the defendant's thrown away costs.
