Procedural Posture

Civil Appeal / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicants have met the conditions for grant of stay of execution pending appeal under Order 42 Rule 6(2) of the Civil Procedure Rules.
  2. 2 Whether substantial loss may result to the applicants if stay is not granted.
  3. 3 Whether the application for stay was made without unreasonable delay.

Ratio Decidendi

The court found that the applicants had filed the application for stay of execution timeously and established a risk of substantial loss if execution proceeded, as the respondents had not demonstrated their ability to refund the decretal sum should the appeal succeed. The court held that the applicants had met the conditions under Order 42 Rule 6(2) of the Civil Procedure Rules for grant of stay, but to balance the interests of both parties, ordered that the decretal sum be deposited in a joint interest earning account of the parties' advocates or in court within 30 days. Costs were ordered to be in the cause.

Court Disposition

Application for stay of execution allowed on condition of deposit of decretal sum.

Orders

  • Applicants to deposit the decretal sum in a joint interest earning bank account of the counsels for both parties or in court within 30 days from the date hereof.
  • Costs of the application to be in the cause.
