The Defendants failed to demonstrate discovery of new and important matter or evidence, or any mistake or error apparent on the face of the record. The application was essentially an attempt to vary the decree to enable the Defendants to sell or mortgage the suit property, but the property was already in the Plaintiff's name, and the Defendants had not provided an alternative property or refunded the purchase price as required by the consent judgement.
