The court found that the protestor, Njagi Murungi, had already received a substantial gift inter vivos from the deceased (LR No. Magumoni/Thuita/481, approximately 4 acres) during the deceased's lifetime. By operation of section 42 of the Law of Succession Act, this prior gift must be taken into account when distributing the remaining estate.
