Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the defendant passed good title of the motor vehicle to the plaintiff under the sale agreement.
  2. 2 Whether the plaintiff was entitled to a refund of the purchase price and general damages for alleged fraud or failure of title.

Ratio Decidendi

The court found that at the time of sale, the respondent was the registered and legal owner of the vehicle and therefore had the right to sell and pass good title to the appellant. The evidence from the National Transport and Safety Authority confirmed the respondent's ownership at the material time. The presumption under section 8 of the Traffic Act applied, and the burden was on the appellant to prove fraud or lack of title, which he failed to do. Consequently, there was no breach of the sale agreement or basis for refund or damages. The trial magistrate's decision was upheld, and the appeal was dismissed with costs to the respondent.

Court Disposition

appeal dismissed

Orders

  • The appeal is dismissed.
  • The appellant shall pay costs of the appeal assessed at Kshs. 30,000 exclusive of court fees.
